Terms of Service

These terms are the agreement between you and Diggby. By subscribing to or using the service, you agree to them — so please read them.

01Acceptance

By accessing or using Diggby, you agree to these Terms of Service and our Privacy Policy and Acceptable Use Policy, which are incorporated by reference. If you use Diggby on behalf of an organization, you represent that you have authority to bind it. If you don't agree, don't use the service.

02The service

Diggby provides subscription access to commercial-intent data feeds — newly-formed and newly-licensed Alberta businesses, construction permits, liquor and licence filings, and related signals — together with a dashboard and contact details compiled from public records. Features, coverage, and data may change as we improve the product.

03Your account

You are responsible for activity under your account and for keeping your sign-in secure. Diggby uses passwordless magic-link login; do not share access links or let non-subscribers use your account. Notify us promptly of any unauthorized use.

04Subscriptions & billing

  • Subscriptions are billed in advance on a recurring (typically monthly) basis through Stripe.
  • Your subscription auto-renews each period until you cancel.
  • You may cancel anytime; cancellation takes effect at the end of the current billing period, and you keep access until then.
  • Except where required by law, fees are non-refundable and we don't prorate partial periods.
  • We may change prices or plans with reasonable advance notice; changes apply to the next renewal.

05Acceptable use

Your use of Diggby is governed by our Acceptable Use Policy. In short: use the data for your own legitimate business development; do not resell, redistribute, scrape, or republish it; and comply with Canada's Anti-Spam Legislation (CASL) and applicable privacy law whenever you contact a lead.

06Data accuracy & no reliance

Diggby's data is compiled from third-party public records and provided "as is" and "as available." We work hard on quality, but we do not warrant that any signal, contact, or record is accurate, complete, current, or fit for a particular purpose. You are responsible for independently verifying information before acting on it.

Diggby is an intelligence tool, not legal, financial, credit, or professional advice. Decisions you make using the data are your own.

07Intellectual property & your licence

The Diggby service, the compilation and arrangement of the data, the software, and all related trademarks are owned by Diggby. During your active subscription we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the data internally, for your own business. All rights not expressly granted are reserved.

08Suspension & termination

You may cancel at any time. We may suspend or terminate your access if you breach these terms, fail to pay, or use the service unlawfully. On termination, your licence to use the data ends and you must stop using it.

09Disclaimers

To the fullest extent permitted by law, the service is provided without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement.

10Limitation of liability

To the fullest extent permitted by law, Diggby will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the service is limited to the fees you paid to Diggby in the three months before the event giving rise to the claim.

11Indemnity

You agree to indemnify and hold Diggby harmless from claims, losses, and expenses arising out of your use or misuse of the service or data, or your violation of these terms or applicable law.

12Governing law & changes

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, and the courts of Alberta have exclusive jurisdiction. We may update these terms; material changes will be posted here, and your continued use means you accept them.
